Work Permits with LMIA

A Labor Market Impact Assessment (LMIA) is a document that a Canadian employer may need before hiring a foreign worker. Most Canadian work permits require an LMIA to hire a temporary foreign employee. To obtain a positive LMIA, employers must demonstrate the need for a foreign worker to fill the role and prove that no Canadian worker is available for the position.

LMIA-Based Work Permit Requirements:
Obtaining an LMIA-based work permit in Canada generally involves two steps. First, the employer applies to Employment and Social Development Canada (ESDC) for an LMIA. After receiving a positive LMIA, a second application is submitted to Citizenship and Immigration Canada (CIC) for the work permit itself. The LMIA confirms that hiring a foreign worker will not negatively impact the Canadian labor market.

Since July 2014, work permits for LMIA-required positions in low-wage occupations have typically been limited to one year.

To apply for a work permit, the foreign worker needs:

  • A job offer letter
  • An employment contract
  • A copy of the LMIA
  • The LMIA number
